Terms and Conditions

  1. Payment: The total fee for the training sessions must be received prior to commencing the first training session.
  2. Duration: All training sessions are of approximately one(1) hour duration.
  3. Fees will not be refunded nor reduced if the client arrives after the agreed time thereby reducing the training session to less than one(1) hour. If you arrive late, the sessions will not be extended beyond the scheduled end time.
  4. Design of training programs: Training programs are designed by the trainer based on the personal and medical information provided by the client in the Pre Activity Questionnaire and any other information disclosed by the client or his/her doctor and recorded by the trainer.
  5. Attendance at the training sessions: The clients must be punctual in his/her attendance at all training sessions. If the client is attending on that day, but is delayed for any reason, then client must notify the trainer as far in advance as possible.
  6. Clothing and footwear: The client must wear exercise footwear and clothing appropriate for the type of training session to be undertaken. The trainer reserves the right to exclude the client from the training session if he/she attends wearing inappropriate footwear or clothing.
  7. Personal Hygiene: The client must observe accepted standards of personal hygiene, such as use of deodorant. If the client does not comply with hi/her obligations under this paragraph, the trainer may, at his/her discretion, exclude the client from the class.
  8. Disclaimer: The trainer accepts no responsibility for any loss or damage to the client's personal items during a training session.
  9. Cancellation of training sessions

  10. Cancellation: Classes are held rain, hail or shine. You should always assume that the class is on unless you have heard directly from your trainer of any changes to the schedule.
  11. Refunds: There are no refunds once payment has been made and training has commenced.
  12. Extension: If you cannot attend because of serious illness or injury, your payment can be put on hold for up to three(3) months. If the injury or serious illness is still present at the end of the three(3) month period, we may extend for another three(3) months. But this is at the trainers discretion. Cold or flu does not fall under the serious illness category.
  13. Trainer's exclusion option: If the trainer exercises his right to exclude a client from a training session in accordance with paragraphs five(5) or six(6) then the client shall not be entitled to a refund.
  14. Trainer's cancellation option: The trainer may cancel any or all training sessions immediately without notice. If the trainer exercises their right to cancel the training session(s), the client will be entitled to a refund of fees paid pro-ratad in respect of all training sessions that are cancelled.

  15. Direct debit terms and conditions

    Direct debit is the most convenient payment method, but there are just a few things you need to remember.
    Simply make sure there is enough money in your account and if you want to cancel, or put your membership on hold, make sure you do it 3 business days before the end of the week.
    There are no fees associated with your direct debit from a bank account, but if you choose to pay by credit card, you will have to absorb all of the fees.

  16. Payment date: Payment will be scheduled for deduction on the Monday of each week until the client cancels this direct debit authority in writing.
  17. Amount: By authorising Fitta Bodies to direct debit your bank account, you agree to pay $50 per week (or a pre-arranged designated fee) ongoing until such direct debit is cancelled in writing.
  18. Minimum term: There is no minimum term other than the one you have paid for.
  19. Cancellation: You may cancel anytime so long as you give the required amount of notice (see below) to allow cancellation to take place. There are no fees associated with cancelling your membership.
  20. Holding membership:You may put your membership on hold at anytime so long as you give the required amount of notice (see below) to process the hold. The minimum hold time is 1 week. There are no fees associated with holding your membership.
  21. Notice: You must give atleast 3 business days notice before payment is due to be deducted from your account in order for payment to be cancelled or held. You agree that if you do not give sufficient (3 business days) notice, another scheduled payment will be deducted and can not be refunded.
  22. Fees: There are no transaction fees associated with a direct debit from your nominated bank account.
    If you choose to use a credit card for payment, there is a transaction fee of $1.25 and there are additional fees ranging from 1.9% to 4.4% or more, all of which are payable by you, the client.
  23. Insufficient funds: If you have insufficient funds in your bank account, your bank may charge a fee for a failed attempt at direct debit. You are responsible for maintaining adequate funds in your account to meet the payment requirements and as such, Fitta Bodies is not responsible for any fees you may incur for failed attempts at direct debitting your bank account.
  24. End of trial: I understand that after my intial trial, the designated weekly fee will be deducted from my bank account until such direct debit is cancelled or held in writing.
  25. Cancellation after trial: I understand I must give atleast 3 business days notice before payment is due to be deducted in order to cancel or hold the first payment after my trial.
  26. Consent

    I, the client:
  • Have read, understood and agree to be bound by the above Terms and Conditions.
  • Agree to voluntarily undertake a group personal training program structured and supervised by Fitta Bodies Personal Training or it's affiliate training companies.
  • Indemnify Fitta Bodies, it's employees, contractors, subcontractors, representatives, agents and advisors against any liability arising directly or indirectly out of any loss, injury, illness, adverse change in medical condition or state of health, accident or condition arising directly or indirectly from any current or future training or exercise program recommended by or undertaken with Fitta Bodies Personal Training and.or it's employees, contractors or subcontractors.
  • Authorise Fitta Bodies Personal Training or it's affiliate training companies to seek all relevant information relating to my health and medical background.
  • Agree to inform my trainer upon change of prescription drugs or any medication which I may be taking.
